Agreement: Therapeutic Art Coaching and Denise Livingston agree to provide their services to the client as mentioned in the agreement. Description: Coaching is cooperation (not a business or legal partnership/cooperation) between the Client and the Coach in an innovative way that inspires the client to maximize his/her personal and professional skills and capabilities.

Responsibilities: The Coach agrees on maintaining the standards and ethics of behavior as per set by the International Coach Federation (ICF). www.coachfederation.org/ethics Client is responsible for establishing his/her own emotional, mental, and physical wellbeing. Client is also responsible for his/her choices, decisions, behaviors, and actions and the consequences of all of these. The client agrees not to hold Coach accountable or responsible for any action or inaction as well as any direct or indirect results of any services provided by the coach. The client should understand that coaching does not work as a therapy, nor it is a therapy itself. It neither treats any mental disorder or medical problem nor does it prevent it. Client knows that coaching is not an alternative for any professional advice by legal, medical, mental, or any other qualified professionals and he will seek professional help for respective matters from independent professionals. The client must inform the coach about his/her mental health care provider if the client is undergoing any mental health problem and is under the care of a professional. Client understands the importance of honesty and agrees to communicate openly, honestly, share genuine feedback, and will offer his/her full energy to participate in the coaching program.

SERVICE AGREEMENT

Confidentiality: This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (like in Medicine or Law). The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) that the Coach is required by law to disclose. For more detailed information regarding confidentiality, please refer to the Confidentiality Agreement document.

Limited Liability: Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. In no event will the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date. This, including the Company Policies, Communication Agreement, Confidentiality Agreement, Statement of Intent and Relevant Treatment Information, is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations.

If a dispute arises out of this agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

Cancellation Policy

The Client agrees that it is the Client’s responsibility to notify the Coach 24 hours in advance in case of cancellation of the scheduled calls/sessions. The Coach will attempt in good faith to reschedule the missed meeting. The Coach reserves the right to charge the Client for a missed meeting. If the Client cancels within 24 hours of the scheduled call/session and/or is a no-show for two coaching sessions within the same Client Agreement period, the Coach will provide a written email warning of this fact and remind the Client that a $60 cancellation fee will be charged to the Client the next time the Client cancels within 24 hours of the scheduled call/session or does not show to the call. Once the Coach receives a cancellation notice, the Coach will confirm the cancellation via text message or email.

Termination Policy

Either the Client or the Coach may terminate this agreement at any time with a 1 week written notice via email. Due to the intricate nature of coaching, the Client will continue to work with the Coach during that 1 week period. At least 1 coaching session can or will take place after the 1 week written notice is received. The goal of the remaining session(s) will be geared towards completion and preparing for what lies ahead in the Client’s life.

COMPANY POLICIES

Refund Policy

All paid coaching sessions must be used within 365 days from date of purchase and can be gifted to someone provided the new Client is ready and willing to actively participate in the coaching program.

No cash refunds will be issued unless cash was received for payment. Otherwise, all refunds will be issued using the original payment method. All refunds will be issued by Therapeutic Art Coaching within 3 business days of the last coaching session, which is considered the service end date. Refunds will be applied to your bank or credit card within 3 days of service end date unless your bank or credit card company takes longer. We do not have control over this process as it’s the creditor’s responsibility to credit your account. If you have any questions regarding this, please contact your bank or credit card company. All tangible materials such as books, workbooks, worksheets, etc. are not returnable and not refundable. All of those are yours to keep.

Single Coaching Session:

There are no refunds available for single coaching sessions, only rescheduling is possible.

Coaching Packages And Programs:

If the Client requests to cancel the Client Agreement before the first session, a full refund will be issued using the original payment method. If the Client decides after the 2nd session that they no longer days in want to continue with the coaching program, the Client must provide a written email notice to the Coach within 24 hours after the 2nd session. Then the Coach will issue a refund of any unused sessions, less a $30 administrative fee. Once the written email notice of the Client’s desire to terminate their Client Agreement is received, any unused portions of the paid coaching program will be refunded on a pro-rated basis. The pro-rating is based on the unused sessions within the coaching program that was purchased, less a $30 early termination fee.

Events, Seminars and Workshops:

If you need to cancel your attendance to a live event such as, a seminar, workshop or retreat, you will need to email a cancellation request 2 days in advance. Please email at: denise@therapeuticartcoaching.com.

NONDISCLOSURE/CONFIDENTIALITY/RELEVANT TREATMENT AGREEMENT

The conversations that we have within our coaching sessions are confidential and will be protected as such. Your information will only be shared outside of our sessions with your written consent or if a Court Judge demands it.

However, the following are instances where I, your Coach, would be obligated by law to break our confidentiality agreement without your permission:

If it is assessed during your participation in our coaching sessions that abuse or neglect of children or elders is occurring. If during our coaching sessions you threaten to kill or harm another individual, and I am convinced that you will act on this threat, or that you may lose control of your actions. If at any time during our sessions, I determine that you are a danger to yourself, I will inform you of that opinion and make every effort to keep you from endangering your life. In some cases, this may include notifying the police or your emergency contacts. The client agrees to mention working with any of the following individuals (e.g., counselor, therapist, psychologist, psychiatrist, nutritionist, homeopathic practitioner, or any other medical professional).

STATEMENT OF INTENT/DISCLAIMER ENDORSEMENT

Coaching may augment therapy, but the work of coaching is meant to be done when major emotional and psychological wounds are already healed. All coaching services delivered by Therapeutic Art Coaching are meant to challenge and motivate you. If at any point during our work together you feel stressed to the point that it is interfering with your ability to function, please seek the help you need in the form of a professional counselor, therapist, psychiatrist, or other mental health care professional or ask me for support and encouragement to do so. I can provide highly reputable referrals, if needed, so please do not hesitate to ask.

By agreeing to Therapeutic Art Coaching’s Terms & Policies, you:

  • Understand the coaching services I will be receiving from Therapeutic Art Coaching are not offered as a substitute for mental health care or counseling services.

  • Understand Therapeutic Art Coaching is non-clinical art therapy and that Denise Livingston is not a clinical art therapist.

  • Understand that my coach, Denise Livingston, is not acting as any medical professional and does not purport to offer mental health care.

  • Understand the verbal and written information provided by Denise Livingston and/or Therapeutic Art Coaching does not constitute legal or professional advice neither is it intended to be. Information is offered in good faith – you do not have to use this information.

  • Understand and agree that I am fully responsible for creating my own results and acknowledge that results are not guaranteed.

  • Understand and agree that I am fully responsible for the choices and decisions that I make as well as any resulting consequences.

  • Understand that all comments and ideas offered by Denise Livingston and/or Therapeutic Art Coaching are solely for the purpose of aiding me in achieving my defined goals. I have the ability to give my informed consent, and hereby give such consent to Denise Livingston and/or Therapeutic Art Coachingto assist me in achieving such goals.

  • Understand that coaching is a professional relationship, and it is one that cannot extend beyond professional boundaries during our work together.
